The U.S. Centers for Disease Control and Prevention estimates that 1 in 88 children in the United States has been identified as having an autism spectrum disorder (ASD), according to a new study released March 29 that looked at data from 14 communities. Autism spectrum disorders are almost five times more common among boys than girls -- with 1 in 54 boys identified.

The number of children identified with ASDs ranged from 1 in 210 children in Alabama to 1 in 47 children in Utah. The largest increases were among Hispanic and black children.

The report, Prevalence of Autism Spectrum Disorders -- Autism and Developmental Disabilities Monitoring Network, 14 Sites, United States, 2008, provides autism prevalence estimates from 14 areas. It was just published in the Morbidity and Mortality Weekly Report.

"This information paints a picture of the magnitude of the condition across our country and helps us understand how communities identify children with autism," said Health and Human Services (HHS) Secretary Kathleen Sebelius. "That is why HHS and our entire administration has been working hard to improve the lives of people living with autism spectrum disorders and their families by improving research, support, and services."

"One thing the data tells us with certainty -- there are more children and families that need help," said CDC Director Thomas Frieden, M.D., M.P.H. "We must continue to track autism spectrum disorders because this is the information communities need to guide improvements in services to help children."

Zachary Warren, Ph.D., director of the Vanderbilt Kennedy Center's Treatment and Research Institute for Autism Spectrum Disorders at Vanderbilt University, says effective early identification and treatment of autism is a public health emergency.

"The new CDC data is the best evidence we have to date that autism is a very common disorder. While recent estimates have varied, we have always known the individual, familial, educational and societal costs that go along with autism are tremendous," Warren said. "We are now seeing autism in more than 1 percent of the population, which highlights how challenging it will be for systems of care to meet service needs."

The results of CDC's study highlight the importance of the Obama administration's efforts to address the needs of people with ASDs, including the work of the Interagency Autism Coordinating Committee (IACC) at the U.S. Department of Health and Human Services. The IACC's charge is to facilitate ASD research, screening, intervention, and education. As part of this effort, the National Institutes of Health has invested in research to identify possible risk factors and effective therapies for people with ASDs.

Study results from the 2008 surveillance year show 11.3 per 1,000 8-year-old children have been identified as having an ASD. This marks a 23 percent increase since the last report in 2009. Some of this increase is due to the way children are identified, diagnosed and served in their communities, although exactly how much is due to these factors is unknown. "To understand more, we need to keep accelerating our research into risk factors and causes of autism spectrum disorders," said Coleen Boyle, Ph.D., M.S.Hyg., director of CDC's National Center on Birth Defects and Developmental Disabilities.

The study also shows more children are being diagnosed by age 3, an increase from 12 percent for children born in 1994 to 18 percent for children born in 2000. "Unfortunately, 40 percent of the children in this study aren't getting a diagnosis until after age 4. We are working hard to change that," said Boyle.

?We were trying to find something that modeled a little more closely what you see in the human experience,? Hosking says. ?In everyday life, it?s the cognitive side where people really have to make those decisions, like whether you work harder throughout the day in hopes of getting a promotion, or coast through and check Facebook every 15 minutes and earn your wages.?

In the study?s rodent analog of a work day, rats poked their nose into one of five holes to indicate the location of a flash of light. By pushing a lever before the trial began, the rats chose either an easy version or a hard one. In the easy task, the light shone for a full second, making its location easy to spot. In the hard version, the light briefly flashed for a fifth of a second, a time so brief that the rats had to really concentrate to choose the right hole. The harder task came with double the sugar-pellet reward.?

When compared to the average behavior, some individuals reliably went for the easy version and collected their small reward. Other animals overwhelmingly chose the intellectually harder route. Not only do these divisions between what the team termed slackers and workers exist, the researchers showed, but the differences persist across many trials.

?This article opens up a new area related to mental effort,? says behavioral neuroscientist John Salamone of the University of Connecticut in Storrs. For instance, scientists can now start to explore the relationship between physical and mental work.

Giving rats the stimulants amphetamine and caffeine produced varied effects depending on individual?s personality, the team found. For slacker rats, amphetamine sharpened the mental work ethic, making the animals more likely to choose the harder task. But for workers, amphetamine caused the animals to choose the easier option more. Meanwhile, caffeine turned worker rats into slackers, but didn?t make the slackers work any harder.?

The researchers can?t yet explain why stimulants would cause workers to choose the easier task. One possibility is that hard workers are already performing optimally, so anything that swings the system out of whack, such as stimulants, could cause a net decrease in productivity.

More generally, the results show that drugs aren?t necessarily one-size-fits-all, Salamone says.

They talk with their financial planner who refers them to a new attorney; or worse, the parties create a will or joint revocable living trust using an online legal service.?? During this process the parties forget to disclose the existence of the prenuptial agreement. The existence of the prenuptial agreement isn?t mentioned in the wills or trust and the estate planning documents potentially destroy the effectiveness of the prenuptial agreement.

For example, the couple executes a joint revocable living trust which states that all of their joint property is listed in a schedule following the trust. The schedule lists all of the couple?s property, including their separately owned property.? The property is retitled in the trust?s name.

By doing this, the parties may have destroyed the prenuptial agreement and made it ineffective. Years down the road, the parties may decide they want to divorce.? By moving all of their property to the trust and titling the property in the name of the trust, the parties may have inadvertently converted separately owned assets into jointly owned assets.

In other words each spouse could have a 50 percent interest in the other spouse?s separately owned property ? something that the prenuptial agreement was made to protect against.? There is Oregon case law that can help to avoid this result but those cases are fact specific and there is no clear law in this area.

At the very least the couple will have an expensive divorce fighting over whether property is separate or joint.

Here are some steps to continue to preserve ownership of property identified as separate property in a prenuptial agreement:

1. Accurately identify all separate and jointly owned property in the prenuptial agreement.
2. Do estate planning at the same time that the prenuptial agreement is being created.
3. Don?t use self-help legal services to create a prenuptial agreement or estate planning documents.? Enforceable prenuptial agreements must meet several legal requirements that will most likely be overlooked if you try to draft a prenuptial agreement on your own.? Execution of simple estate planning documents may save money in the beginning, but will most likely result in an expensive legal proceeding in the future.
4. Make sure you tell your attorney that you have a prenuptial agreement. ?After you are married you may want to get rid of the prenuptial agreement altogether or change certain provisions of the prenuptial agreement to benefit your spouse.
5. Ensure that all separately owned property is always titled in that spouse?s name who owns the property and that the property is not integrated or commingled with other assets in the marital estate.
6. Don?t use a joint revocable living trust unless safeguards are put in place that reference the prenuptial agreement, dictate what happens to separate property upon divorce or death, and accurately identifies and labels all separate and jointly owned property.

As stated above, cases involving the enforceability and application of prenuptial agreements are fact specific.? It?s virtually impossible to create an ?iron clad? prenuptial agreement since attorneys cannot control their clients after the prenuptial agreement is signed.? Although the above steps and other steps may not avoid expensive litigation, they can help successfully defend claims by one spouse against the other spouse?s separate property in situations where a prenuptial agreement is in place.

Mali army claims upper hand over rebels amid coup disarray

Malian soldiers on Sunday repelled a fresh attack by Tuareg rebels in the north following a coup as the junta struggled to restore order after ousting the west African nation's president.

The Tuareg had said they were advancing on the key northern town of Kidal, but a military official in the town told AFP the rebels had been pushed back.

"Today we repelled an attack by Islamist rebels," a military official in Kidal told AFP on condition of anonymity, referring to one of two rebel movements fighting for independence of the traditional homeland of the desert nomads.

The desert tribes in January launched their first rebellion since 2009 in a decades-old demand for independence, boosted by the return of heavily-armed battle-hardened fighters from Libya who served late dictator Moamer Kadhafi.

Their forces overwhelmed the weak Malian army, and scores of soldiers are said to have been killed and captured, causing anger among troops over the way the conflict is being handled by the government.

Angry soldiers revolted in Bamako Wednesday, leading to a full-blown coup early Thursday as they seized government buildings and forced the president to flee.

Junta leader Captain Amadou Sanogo has invited the rebels to hold talks and begin a "peace process" as he tries to restore order.

Bamako was tense on Sunday with few people venturing out as security forces patrolled the streets.

Banks and most shops were shut in the usually bustling city, although some petrol stations have reopened after being asked to do so by the junta.

President Amadou Toumani Toure's whereabouts are unknown, but he is believed to be safe under the protection of his loyalist paratrooper guard, while 14 members of his government detained by the putschists have threatened a hunger strike.

"There are 14 of us in a room of 12 square metres, sleeping three to a mattress. Our basic rights are being violated," said a message from one of the officials sent to AFP.

They are being held at the Kati military barracks outside Bamako where Sanogo is seeking to reinforce the impression of control, holding meetings and making several public declarations.

He met French ambassador Christian Rouyer and other dignitaries on Saturday, state television reported, but the junta has been largely frozen out by the international community in a chorus of rebukes and suspension of aid.

On Sunday, Nairobi announced that the Kenyan and Zimbabwean foreign ministers were evacuated by a chartered flight after being stranded in Mali following the coup.

After widespread looting by soldiers in the coup aftermath, the junta urged "all those in uniform to report to their barracks for an inspection" and reminded unit commanders they were responsible for their men.

On Saturday Sanogo took to the television to show he was still alive and douse rumours of a counter-attack by loyalist troops.

The Tuareg rebels said in the wake of the coup they would continue their offensive, and The Islamist rebel group Ansar Dine, or Defenders of Faith in Arabic, said Saturday its fighters had surrounded Kidal.

"Thanks to Allah the almighty and his blessings, we will soon take our land in Kidal," said a statement from the group.

While Ansar Dine is demanding the imposition of Islamic law, the other rebel group, the Azawad National Liberation Movement (MNLA) has distanced itself from religious objectives.

Mali will on Monday will mark the 21st anniversary of the last coup, when Toure led the overthrow of dictator Moussa Traore and steered the country to its first democratic election a year later for which he is considered a hero.

After Mali's democratic advances in the past two decades, Thursday's coup alarmed the international community which reacted with swift condemnation.

The African Union temporarily suspended Mali, while Europe and Canada froze aid and the United States has threatened to follow suit.

A joint mission from the African Union and Economic Community of West African States met representatives of the junta on Friday, according to Mali state television, without giving further details.

ECOWAS heads of state will hold an emergency meeting in Abidjan on Tuesday, the day the junta has called for civil servants to return to work.

Stocks edge up but global economic worries linger

NEW YORK (AP) ? Stocks eked out a small gain at the end of a rough week in which the market was weighed down by prospects of a global economic slowdown.

The Dow on Friday closed up 34.59 points, or 0.3 percent, at 13,080.73. Financial stocks performed well, led by a 2.6 percent gain for Bank of America.

For the week, the Dow Jones industrial average was off 152 points, the worst in a month despite reports of strengthening in the U.S. jobs market and better corporate profits. Investors were worried about a slowdown in Asia and Europe and the impact of higher oil prices on consumer spending.

Home builders and home improvement stocks fell Friday after the Commerce Department said sales of new homes fell 1.6 percent last month. PulteGroup fell 2.6 percent and Lennar declined 1 percent, while Lowe's and Home Depot fell a little less than 1 percent.

In other trading, the Standard & Poor's 500 index inched up 4.33 points, or 0.3 percent, to 1,397.11 and the Nasdaq composite rose 4.6 points, or 0.1 percent, to 3,067.92.

A wide range of companies including Nike, Oracle, FedEx, and Tiffany have reported stellar earnings this week. However, those accomplishments were marred by worries of the effect of a slowdown in Asia and Europe on the companies that rely on global sales. Reports in China and Europe earlier in the week pointed to a likely slowdown in those economies.

Nike was off 3.2 percent, FedEx down less than 1 percent and Tiffany was off 1.4 percent.

"Investors are scared so they're seeing a glass half empty rather than a glass half full," said Rob Lutts, president at Cabot Money Management.

American consumers, who drive two-thirds of the economy, are spending more in stores and restaurants. But investors are worried about how long that will last if oil prices continue to rise.

Darden Restaurants, which operates Olive Garden and Red Lobster, beat Wall Street forecasts with an 8.5 percent increase in profits after warm weather brought more people to its restaurants. But Darden stock fell 1.7 percent.

Crude oil rose 1.4 percent after a brief downturn Thursday. Gasoline has risen 59 cents per gallon since Jan. 1 and the average price nationwide is above $4 in at least eight states, plus the District of Columbia.

And then there is China and Europe. New surveys showed a contraction in the manufacturing sector in China, a bellwether for world demand as it produces and exports a huge amount of consumer goods. In Europe, Ireland dipped back into recession.

However, Lutts believe the worries are overblown. "Though China is slowing, I'm not that worried because the government will do all it can to get growth back on track," he said.

Treasury prices and gold rose. The yield on the benchmark 10-year Treasury note fell to 2.23 percent.

In other corporate news:

? Micron Technology fell 3.6 percent, one of the biggest drops in the S&P 500. The maker of computer chips and flash memory reported a larger loss than analysts expected after the market closed Thursday.

? KB Home stock plunged 8.5 percent after it said there was a spike in cancellations of contracts for new homes between December and February, driving its home orders down 8 percent. Buyers canceled orders because KB Home raised prices and some mortgage lenders backed away from making loans.

? Fertilizer maker Mosaic Co. was up 2.5 percent after JPMorgan analysts upgraded the stock for securing new contracts.

? Morgan Stanley stock moved up 3.8 percent, after a Credit Suisse analyst upgraded its stock on an improved outlook for its investment banking business.

3 blasts outside hideout of French terror suspect

TOULOUSE, France (AP) ? Three explosions were heard near an apartment building in southwest France where a suspected gunman is holed up, but an Interior Ministry spokesman would not confirm the blasts meant the start of an assault.

Another Interior Ministry official, speaking on condition of anonymity because of office rules, said the suspect had gone back on a previous decision to turn himself in ? and that police had blown up the shutters outside the apartment window to pressure him to change his mind.

Interior Ministry spokesman Pierre-Henry Brandet would not confirm an assault.

Orange flashes lit up the night sky with each blast near the Toulouse apartment building where police have been surrounding 24-year-old suspect, Mohamed Merah, since a pre-dawn effort to arrest him went awry.

TOULOUSE, France (AP) ? Riot police surrounded an apartment building into the night on Wednesday, laying siege to a gunman who boasted of bringing France "to its knees" by carrying out an al-Qaida-linked terror spree that killed seven people.

Hundreds of heavily armed police, some in body armor, cordoned off the five-story building in Toulouse where the 24-year-old suspect, Mohamed Merah, had been holed up since the pre-dawn hours.

As midnight approached, three explosions were heard and orange flashes lit up the night sky near the building.

Authorities said the shooter, a French citizen of Algerian descent, had been to Afghanistan and Pakistan, where he claimed to have received training from al-Qaida.

They said he told negotiators he killed a rabbi and three young children at a Jewish school on Monday and three French paratroopers last week to avenge the deaths of Palestinian children and to protest the French army's involvement in Afghanistan, as well as a government ban last year on face-covering Islamic veils.

"He has no regrets, except not having more time to kill more people and he boasts that he has brought France to its knees," Paris Prosecutor Francois Molins told a news conference.

The standoff began when a police attempt at around 3 a.m. to detain Merah erupted into a firefight. Three police were wounded, triggering on-and-off negotiations with the suspect that lasted into the night.

As darkness fell, police cut electricity and gas to the building, then quietly closed in to wait out the suspect.

Authorities were "counting on his great fatigue and weakening," said Didier Martinez of the SGP police union, adding the siege could go on for hours. Street lights were also cut, making Merah more visible to officers with night vision goggles in case of an assault.

French authorities ? like others in Europe ? have long been concerned about "lone-wolf" attacks by young, Internet-savvy militants who self-radicalize online since they are harder to find and track. Still, it was the first time a radical Islamic motive has been ascribed to killings in France in years.

Merah espoused a radical brand of Islam and had been to the Afghanistan-Pakistan region twice and to the Pakistani militant stronghold of Waziristan for training, Molins said.

He said the suspect had plans to kill another soldier, prompting the police raid.

The gunman's brother and mother were detained early in the day. Molins said the 29-year-old brother, Abdelkader, had been implicated in a 2007 network that sent militant fighters to Iraq, but was never charged.

After bouts of deadly terrorist attacks in France in the 1980s and 1990s, France beefed up its legal arsenal ? now seen as one of the most effective in Western Europe and a reference for countries including the U.S. after the Sept. 11 attacks.

Sarkozy's office said President Barack Obama called him Wednesday to express condolences to the families of the victims and praise French police for tracking down the suspect. The statement said France and the United States are "more determined than ever to fight terrorist barbarity together."

In recent years, French counterterrorism officials have focused mainly on al-Qaida in the Islamic Maghreb, the North African affiliate of Osama bin Laden's network that has its roots in an insurgent group in Algeria, a former French colony.

Molins said Merah's first trip to Afghanistan ended with him being picked up by Afghan police "who turned him over to the American army who put him on the first plane to France."

"He had foreseen other killings, notably he foresaw another attack this morning, targeting a soldier," Molins said, adding also planned to attack two police officers. "He claims to have always acted alone."

Merah has a long record as a juvenile delinquent with 15 convictions, Molins added.

An Interior Ministry official, speaking on condition of anonymity, said Merah had been under surveillance for years for having "fundamentalist" Islamic views.

During the standoff, police evacuated the five-story building, escorting residents out using the roof and fire truck ladders. The suspect's apartment was on the ground floor of the postwar building, locals said.

French authorities said Merah threw a Colt .45 handgun used in each of the three attacks out a window in exchange for a device to talk to authorities, but had more weapons like an AK-47 assault rifle. Gueant said other weapons had been found in his car.

"The main concern is to arrest him, and to arrest him in conditions by which we can present him to judicial officials," Gueant added, explaining authorities want to "take him alive ... It is imperative for us."

Delage said a key to tracking Merah was the powerful Yamaha motorcycle he reportedly used in all three attacks ? a dark gray one that had been stolen March 6. The frame was painted white, the color witnesses saw in the school attack.

According to Delage, one of his brothers went to a motorcycle sales outfit to ask how to modify the GPS tracker, raising suspicions. The vendor then contacted police, Delage said.

The shooter has proved to be a meticulous operator. At the site of the second paratrooper killing, police found the clip for the gun used in all three attacks ? but no fingerprints or DNA on it.

Those slain at the Jewish school, all of French-Israeli nationality, were buried in Israel on Wednesday as relatives sobbed inconsolably. The bodies of Rabbi Jonathan Sandler, his sons Arieh, 5, and Gabriel, 3, and 8-year-old Myriam Monsenego had been flown there earlier in the day.

At the funeral ceremony, Myriam's eldest brother, Avishai, in his 20s, wailed and called to God to give his parents the strength "to endure the worst trial that can be endured."

Palestinian Prime Minister Salam Fayyad, meanwhile, denounced the deadly shooting attack at the Jewish school and condemned the link to Palestinian children.

"It's time for criminals to stop using the Palestinian cause to justify their terrorist actions," Fayyad said in a statement. "The children of Palestine want nothing but dignified lives for themselves and for all the children."

Before he was killed last year, bin Laden stressed the importance of focusing on the Palestinian cause. In what is believed to be a draft letter to al-Qaida's top lieutenant, the al-Qaida leader wrote about the need for the terror group's affiliates to tie their operations to broad concern for Palestine instead of local grievances, according to declassified documents obtained in last year's bin Laden raid that were reviewed by the Washington Post.
